2. Scope of Services

FORTOPWAY TECH SL provides digital services including, but not limited to: custom web development, mobile application development, e-commerce solutions, SEO and digital marketing, UI/UX design, API development and integration, cloud infrastructure and DevOps, cybersecurity consulting, software maintenance and support, and business automation. All services are delivered digitally. No physical products are sold or delivered.

3. Order Process and Payment Terms

Placing an order through our website does not constitute a binding contract. After you submit an order, a representative of FORTOPWAY TECH SL will contact you via the email address you provided to confirm the scope of work, timeline, and pricing. Payment arrangements will be agreed upon during this confirmation process. No payment is required or collected at the time of placing an order online.

A formal agreement or invoice will be issued prior to commencement of any work. Payment terms will be specified in the individual project agreement and may include upfront deposits, milestone-based payments, or monthly retainers depending on the nature of the service.

4. Cancellation and Refund Policy

Due to the nature of digital services, refunds are not available for work that has been completed or substantially commenced. If you wish to cancel a project before work begins, you must notify us in writing at [email protected]. Any deposits paid for work not yet started may be refunded at our discretion, subject to the terms of the individual project agreement.

For ongoing monthly services (retainers), cancellation requires 30 days' written notice. Fees for the current billing period are non-refundable.

5. Intellectual Property

Upon full payment of all agreed fees, the client receives ownership of the deliverables specifically created for their project, as defined in the project agreement. FORTOPWAY TECH SL retains ownership of all pre-existing tools, frameworks, libraries, and methodologies used in the delivery of services.

FORTOPWAY TECH SL reserves the right to display completed work in its portfolio unless the client requests confidentiality in writing.

6. Client Responsibilities

The client agrees to provide accurate information, timely feedback, and any necessary access or materials required for the completion of the project. Delays caused by the client may affect project timelines and costs. FORTOPWAY TECH SL is not responsible for delays resulting from the client's failure to provide required inputs.

7. Limitation of Liability

To the maximum extent permitted by applicable law, FORTOPWAY TECH SL shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or business opportunities, arising out of or in connection with the services provided. Our total liability for any claim shall not exceed the total fees paid by the client for the specific service giving rise to the claim.

8. Confidentiality

Both parties agree to keep confidential any proprietary or sensitive information shared during the course of the engagement. This obligation survives the termination of any project agreement.

9. Governing Law

These Terms and Conditions are governed by the laws of Spain. Any disputes arising from these terms or the services provided shall be subject to the exclusive jurisdiction of the courts of Barcelona, Spain.

10. Changes to These Terms

FORTOPWAY TECH SL reserves the right to update these Terms and Conditions at any time. Changes will be effective upon publication on this website. Continued use of our services after changes are posted constitutes acceptance of the updated terms.
